THE
IVR MID-TERM CONGRESS ON “THE LEGAL OUGHT”
In June 19-20, 2000, a Mid-term Congress
was held in Genoa, Italy, as a frame to the annual meeting of the IVR
Executive Committee. The debates were centred on “The Legal Ought”.
Seven papers were presented in a workshop-like atmosphere during the
two-days Congress, held at the
Law School of the University of Genoa. The speakers and titles were
the following:

REPORT
OF IVR PRESIDENT EUGENIO BULYGIN
Since
the last EC meeting in June 1999 in New York, the IVR Presidency took
care of coordinating the institutional activities of the IVR.
The
Presidency has cooperated with the IVR-Newsletter editor-in-chief, Prof.
Ricardo A. Guibourg, and the General Secretary Prof. Pablo López Ruf,
in publishing and distributing among the National Sections the IVR Newsletter
Nº 24 correspondig to the period February 1999 – January 2000, which
contains a report of Prof. Burton Leiser on the 19th World
Congress held in New York, the announcements of future events (this
meeting in Genoa, World Congresses in Amsterdam and Lund) and the news
from several National Sections. The next issue of Newsletter is planned
for July 2000. Fortunately the Webmaster of the former administration,
Dr. Giovanni Ziccardi, kindly agreed to continue to collaborate with
us as the IVR Webmaster. I wish to express my deep gratitude for his
very important services.
In
co-operation with the Treasury, the Presidency took care of drawing
up the budget and of sending timely reminders to the National Sections
concerning the payments of their fees. We have received from the former
Treasury the amount of u$d 12.925,50. At the date of June 6, 2000, the
IVR funds amount to u$d 11.436,04. The full analysis of the financial
data of the period June 1999 – June 2000 will be given in the report
of the Treasurer, Dr. Carlos E. Pettoruti.
We
have been in touch with Prof. Arend Soeteman concerning the 20th
World Congress to be held in Amsterdam in 2001. Prof. Soeteman will
report about the organization of this event.
We
have also been in touch with legal philosophers in several countries
in which there is no IVR National Section. There are good perspectives
for organizing new National Sections at least in Uruguay, Peru and Paraguay.

OF THE IVR SECRETARY GENERAL PABLO LÓPEZ RUF
During
the period June 1999 – May 2000,
the Secretary General has developed the following activities:
1. Installation
of the IVR venue in Argentina:
Specially the office of the Secretary General,
which counts with the appropriate and necessary building facilities
for its work.

New York EC meeting
Prof. Wellman suggested to read the meeting held
in New York in June 30, 1999, as follows: “the members of the Publication
Committee are Prof. Sprenger, Prof. Leiser, Prof. Krawietz, Prof. Campbell
and Prof. Attwool. The EC approved the minute of the New York meeting
with the changes proposed by Prof. Wellman.
Reports
The reports of IVR President, Secretary General
and Treasurer were approved. In his report, the Director of IVR Newsletter
emphasized the difficulty to get in touch with several national sections.
Prof. Morigiwa declared his willingness to re-establish the contact
with Chinese section. EC members approved.
Publication Committee
The members of the Publication Committee announced
that the authors of the papers selected will be notified soon, and that
the publication will make about six volumes, plus one volume to be published
by Dartmouth and edited by Prof. Campbell. The Committee asked for volunteers
to edit the other volumes. After a brief discussion, the EC members
approved the report and decided that the editors will be selected separately,
in an informal way, by small groups of EC members.
XX World Congress
Prof Soeteman reported about the ongoing organization
of the XX IVR Congress in Amsterdam. He presented a provisional program
and refers to some difficulties to find speakers, to the deal made with
Kluwer Academic Publishers to print a book containing all the papers
that will be presented at the Congress, to the financial situation and
to the registration fees.
XXI World Congress
Prof. Peczenik reported about the ongoing organization
of the XXI IVR World Congress to be held in Lund, Sweden, in 2003. He
distributed a hand-out concerning the dates and the tentative program
of the congress and asked for advice and suggestions. He empasized that
there will be plenary sessions, working groups and workshops, while
there will not be any parallel sessions. Furthermore, the text of the
papers to be presented will be made available beforehand on a data base,
while the final version of the most relevant papers will be published
in a volume afterwards.
XXII World Congress
Prof. Atienza referred to the candidacy of Spain
for hosting the XXII IVR World Congress in Granada, Spain; he declared
that the organisers will be Prof. López Calera and Prof. Atienza himself
and announced that the Congress will probably take place between the
end of May and early June 2005. Prof. Atienza also asked for a formal
letter of acceptance to be sent by the IVR President to the Spanish
organisers.
The IVR EC approved.
Situation of the National Sections; incorporation
of new sections
The President reported about the likely establishment
of national sections in Paraguay, Peru and Uruguay and asked Prof. Tamayo
to report about the situation of Mexico.
After a detailed report by Prof. Tamayo, the IVR
EC expressed its warmest wishes to the new Mexican section and recommended
to incorporate the Mexican association as an IVR National Section. Prof.
Tamayo took the responsibility of organising the Mexican section.
Committee of the IVR Young Scholar Prize
Prof. Sprenger reported about the younger scholar
prize. The commission composed by professors Karlsson, Peczenik and
Tamayo will end the selection by the end of January 2001. The IVR EC
approved.
Other matters
A proposal of the Argentine section was approved
by the IVR EC for hosting the 2002 Mid-term Congress in Buenos Aires,
possibly in March and close to Easter, in order to promote general attendance.
The IVR EC expresses its warmest support to the
initiative on the “Third International Symposium on Philosophy of Law
and Social Philosophy (IVR) in Asia”, also by distributing a hand-out
and urging the attendance of scholars from the rest of the world.
The IVR EC recommends the Secretary General to
start promptly the contacts with IVR National Sections in order to draw
the list of the Nomination Committee members.

Other matters
The IVR EC approves to sponsor the “Italian-Spanish
Seminar in Legal Theory”, a yearly three-days meeting between scholars
from the two areas.
The IVR EC approves that the Mexican jurisprudential
review “Isonomía” be considered as a place where to publish the papers
and proceedings of the IVR National Section of Mexico.
The IVR EC approves that papers in Spanish presented
to IVR Congresses be published, as in the past, in the Spanish review
“Doxa”.
The IVR EC approves the initiative of the University
of Alicante (Prof. M. Atienza) to establish an internet portal devoted
to Spanish-language legal philosophy, with links to other jurisprudential
sites (the “Analisi e Diritto” site, the Bologna IVR site, etc.), and
constitue a virtual library of the jurisprudential literature in Spanish.
The IVR EC acknowledges the invaluable contributions
provided by Prof. Sprenger in the many years at the service of the IVR
and its journal ARSP, deeply regrets his retirement and appoints him
Co-editor of ARSP.

20th IVR WORLD CONGRESS (AMSTERDAM,
THE NETHERLANDS, JUNE 20-24, 2001)
Dates and Venue of the 20th IVR World Congress
The
Congress will be held from Tuesday June 19 through Saturday June 23,
2001. Congress venue is the main building of the Vrije Universiteit,
De Boelelaan 1105, Amsterdam.
The Vrije Universiteit
is located in the south-western part of Amsterdam, close to Schiphol
International Airport and the conference hotels. There are good railway
and bus connections between the Vrije Universiteit, the hotels and the
airport. Participants will receive a detailed route description together
with a confirmation of registration.
Academic Program
The
theme of the Congress is: Pluralism
and Law. Sub-themes include: Justice,
The State, Global Problems and Legal Reasoning.
These sub-themes will be discussed during plenary and semi-plenary sessions
on the different days from Wednesday through Saturday.

topics within these sub-themes will be discussed in workshops. The following

Working Group Papers
Participants
who want to present a paper in a workshop are asked to send the abstract
of their paper to the Congress Committee no later than March 1, 2001.
They are also asked to indicate in which workshop they prefer to present
their paper. However, the Congress Committee cannot guarantee that they
will be placed in their preferred workshop. If abstracts are received
after March 1, 2001, there is no guarantee that the corresponding papers
can be presented during the Congress. Accepted abstracts will be published
in the congress program book.

The official language at the meeting will be English.

Amsterdam
Amsterdam, popular throughout the world, is famous
for its canals, its gabled houses, its museums and of course its atmosphere.
Amsterdam's old inner city is very compact. The museums, monuments,
markets, shopping streets, and other attractions are all within easy
reach by public transport from the symposium venue. Amsterdam also offers
a wide variety of theatres, music halls, etc., in which you can enjoy
all kinds of cultural activities.
Insurance
Please arrange your own travel insurance. The organizers
will not be liable for accidents, theft and property damage, nor for
delays and/or modifications in the program due to unforeseen circumstances.
Although, compared to other cities, Amsterdam is
a rather safe city, we strongly advice you to beware of pickpockets
when you are in the city centre, on trams or buses.
Weather
The Netherlands has a moderate sea-climate.
June is an end-of-spring month with temperatures varying from 18° –
22 °C. A light raincoat and an umbrella are advisable.

In August 11th, 2000, a round table
was held on “Theories of Justice”. Professors Julio C. Cueto Rúa, Martín
D. Farrell and Carlos Ignacio Massini were speakers and Prof. Ricardo
A. Guibourg was the moderator. At the end of the speeches, there was
a public debate.
In October 26-28, the XIV Argentine Conference
on Legal and Social Philosophy took place in Mar del Plata, province
of Buenos Aires. Plenary speakers and their subjects
were: Prof. Miguel A. Ciuro Caldani (Rosario, Argentina), Razones
para la construcción de una teoría trialista del mundo jurídico;
Prof. Juan A. García Amado (León, Spain), Racionalidad y métodos
de la interpretación jurídica; Prof. Cristóbal Orrego (U. of Los

time, the AAFD offered for the first time a young scholar prize. Its winner was Pablo Martín Perot
(U. of Mar del Plata), who exposed his paper Tipos de reglas y el
concepto de obligación jurídica. Homage was rendered to the memory of two legal philosophers recently disappeared:
Hugo Malherbe (U. de la República, Uruguay) and Albert Calsamiglia (U.
Pompeu Fabra, Barcelona, España). Prof. Oscar Sarlo (Uruguay) remembered
Malherbe and Prof. Daniel Mendonca (U.C. de Asunción, Paraguay) referred
to Calsamiglia’s personality. In the afternoons, three workshops allowed
many other participants to expose their papers and have them discussed.
The 69th issue of AAFD bulletin was
published and distributed to national members in July, 2000.
ANNOUNCEMENTS
In April 27-28 2001, a preparatory conference
will be held in Buenos Aires with the same subjects of the XX World
Congress. There, papers to be presented in Amsterdam will have a preliminary
discussion and the scholars or students who do not plan to go to the
World Congress may anyway participate in the debates.
In October 2001, the XV Argentine Conference on
Legal and Social Philosophy will take place in Rosario, province of
Santa Fe.

The 1998 annual conference of the JICLS took place
in August 1998, in Beijing, on the topic “The Theory and the practice
of Governing the state by Law”. The 1999 annual conference of JICLS
took place in August 1999, in Shanghai, on the topic “The retrospection
and expectation in Jurisprudence at the Turn of Century”.
On October 16-18, 2000, the Third Asian Symposium
in Jurisprudence was held in Nanjing, hosted by Nanjing Normal University
and organized by IVR China, Jurisprudence Institute of Chinese Law Society
and Nanjing Normal University in conjunction with IVR Korea and IVR Japan.
The theme of the symposium was “Asia and Legal development in 21st
century.” Professor Sun Wanzhong, Executive Deputy Chair of Chinese
Law Society and Professor Carl Wellman, Honorary President of IVR, delivered
the opening remarks, followed by seven sections of presentations. The

On June 11th - 12th
1999, the Department of Jurisprudence of the University of Copenhagen,
in collaboration with the Danish chapter of IVR, held an international
conference on jurisprudence to commemorate the 100th anniversary
of Alf Ross' birth. Among the speakers were Aulis Aarnio, Robert Alexy,
Eugenio Bulygin, Bruno Celano, David Doublet, Neil Duxbury, Bernard
Gomard, Alexander Molter, Enrico Pattaro, Stanley Paulson, Alexander
Peczenik, Stuart Toddington and Henrik Zahle.
In connection with
the General Assembly on December 1st 1999, Jacob Rendtorff
gave a lecture with the title “Bioetik og ret” (Bioethics and
Law).
In the fall of 2000,
the Danish chapter of IVR has initiated a series of lectures on the
subject "Global Challenges to the Philosophy of Law", held
at the University of Copenhagen. The series will extend into the spring

The last conference of the German Section was
held in Heidelberg from Sept. 21st to 23rd 2000.
It was organized by Professor Winfried Brugger and Professor Görg Haverkate
from the Law Faculty of the Ruprecht-Karls-University of Heidelberg.
140 scholars of legal philosophy, among them guests from Austria, Switzerland,
Italy, Japan, Taiwan, Argentina and Brazil assembled to discuss various
questions under the topic of “Grenzen als Thema der Rechts- und Sozialphilosophie“.
Since the german term “Grenzen“ not only connotes “border“, but also
“limit“, “bounds“ and “threshold“, the 12 speakers had a great variety
of methodological and ontological questions to investigate. Whereas
the plenary sessions in the morning concentrated on the more general
aspects of “Limits of Tolerance“ (Rainer Forst, Frankfurt), “Taboos and Violation of Taboos in Law“
(Matthias Kaufmann, Halle-Wittenberg), “Normal
Case or Extreme Case as a Starting Point of Legal-Philosophical Construction?“
(Erhard Denninger, Frankfurt/M. and Josef Isensee, Bonn), the parallel
sessions in the afternoon gave room to discuss the more specific themes
of “Limits in Medical Law“ and “State and Social Borders“. Especially
in the forum on medical law Norbert Hoerster´s (Mainz) speech on “Legal
Ethics of the Protection of Life at its Beginning and at its End“
provoked not only controversial scientific discussions but also public
protests outside the university compound. But also the other lectures
in this group on “Limits of the Individual and Cloning“ (Ursula
Wolf, Mannheim), “Limits of Patient-autonomy“
(Jochen Taupitz, Mannheim) and “Donation of Organs – at the Limits of Solidarity“ (Thomas Gutmann,
Münich) did not provide simple answers and were discussed thoroughly.
Of the same contemporary interest were aspects dealt with in the other
parallel sessions: Udo Di Fabio (Karlsruhe/Münich), recently appointed
Judge of the Federal Constitutional Court of Germany, spoke on “Displacement or Removal? On the Significance of Borders for Expanding
Europe“, Massimo La Torre (Catanzaro) discussed “Limits of Citizenship: Granting Citizenship to Foreigners as a Means of
Integration or as Termination of Successful Integration?“, Norbert
Horn (Cologne) mused on the “Dissolution
of Borders through Economical Globalization“, whereas Matthias Kettner
(Essen) examined the question of “Dissolution
through Worldwide Communication?“. The vivid discussions proved
the significance of the topic not only in the various fields of legal
theory but also in practical matters. Situated in the venerable Forum
of the Old Auditorium of the University in the centre of the old city
of Heidelberg, the participants found a stimulating atmosphere for conversations
about central issues of present day legal philosophy.
The Study Group on “History of Ideas on Legal
Philosophy“ which was founded by members of the German Section of the
IVR this fall in Heidelberg, announces its first meeting on “Discovery,
Content and Overcoming of the Antithesis of Natural Law and Positive
Law: The Sophists“. The workshop will be held between September 7th
and 9th 2001 in the Congress Center of the Evangelische Landeskirche
Schaumburg-Lippe in the Church Court of Bergkirchen, 31556 Wölpinghausen.
After introductory lectures, the work will concentrate on the interpretation
of selected Sophistic texts. Further information can be obtained through

of the Italian Section of IVR on "Justice and Procedures: Legitimating
Dynamics in the State and in the International Community" took
place in Trieste on September 27-30, 2000.
The Meeting opened
at “Revoltella Museum” with the lectures by Gianni Vattimo (University
of Turin): “Proceduralism (Proceduralisms) as Feature of Modernity”
and by Bruno Romano (University of Rome “La Sapienza”): “‘Thirdness’
of Law and the Market Language”.
The following working
sessions were held at the University of Trieste. The second day was
devoted to the lectures of Giovanni Conso (University of Turin) on “International
and Constitutional Law concerning Human Rights in Trials and the General
Principles of 'the Fair Trial' in Italian Legal System”; Bruno Celano
(University of Palermo) on “Procedural Justice in the Perspective of

The new president
Choi, Prof. Tscholsu Kim, member of the IVR Executive Committee, and
three Korean jurists visited the 3rd Asian Conference on Jurisprudence
held at Nanjing Normal University on October 16-18. President Choi read
a keynote speech “Foundations
of East Asian Jurisprudence” and reported the activities of Korean IVR
Section. He mentioned the new trend for Korean re-unification and the
hope of extending the Conference to Taiwan, North Korea and Vietnam.
On October 22-27,
the Korean Section invited Prof. Carl Wellman, Honorary President of
IVR, and held a Symposium about “Reflections on Rights and Responsibilities”.
Prof. Wellman read his paper “Human Rights and Natural Law”, and Prof.
Chongko Choi presented his paper on “East Asian Jurisprudence of Rights and Responsibilities”.

AMINTAPHIL held its
plenary sessions in California, March 9-11, 2000, at the University
of San Diego School of Law. Larry Alexander handled the local arrangements
and Carol C. Gould, served as Program Chair.
Approximately 35 papers were presented on Justice and the Global
Economy.
This was our first
meeting in which virtually all submissions were transmitted electronically.
Discussion of the papers – via email – commenced before the conference
began.
There were three
paper sessions: (1) Globalization, Markets, Redistribution and Power;
(2) Nations and Cultures; and Justice, Rights, and (3) Dialogue Across
Cultures. A volume of the conference papers is being edited by Richard
Nunan and Carol Gould.
